There are several types of injury and disability claims, they are categorized by the legal system which deals with each type of injury. A personal injury claim comes about when someone negligently hurts someone else, such as an auto accident. Workers' compensation is for job injuries and occupational diseases. The Social Security Administration provides both disability benefits to workers through SSD; and SSI benefits to poor disabled, the elderly, and disabled children. Construction site injuries occur every day. Most construction site injuries occur on the job and involve L&I claims. Many are caused by someone, not your employer or co-employee, given rise to a third party claim.
Personal injury claims are different than job injuries. Personal injuries such as an auto accident involve bodily injury and property damage claims. Workers’ Compensation is for job injuries and occupational diseases. Workers’ Compensation is a no fault system with limited benefits. Benefits include medical, wage, vocational, and disability benefits; but nothing for inconvenience or pain & suffering.
The Federal Government through the Office of Workers Compensation Programs (OWCP) provides wage replacement benefits, medical treatment, vocational rehab, and other benefits to certain workers and their dependents. Their main programs are:
1. Federal Employees Compensation Act for postal workers, federal park rangers, and other federal employees.
2. The Energy of Employees Occupational Illness Compensation Program for employees of the Department of Energy and others.
3. Longshore and Harbor Workers Compensation Act for Longshore workers, ship repair personal, ship builders and other edge of the water employees.
4. Defense Base Act for Workers Compensation protection to civilian employees working outside the United States on US military bases or under contract with the US Government for Public Works or National Defense.
5. Black Lung Benefits Act provides benefits to coal miners and their eligible survivors for black lung disease.
6. The Non-Appropriated Fund Instrumentalities Act. Provides coverage for civilian employees in a PX Exchange or related environment.

Washington State Department of Labor & Industries (L&I). The substantial majority of persons hurt on the job in the State of Washington have an L&I claim. Benefits include medical care, time loss compensation, permanent partial disability, vocational rehabilitation, pensions, and other payments. L&I manages state fund cases and presides over self insured cases.
